2016: New Year, New Goals

By Nicole Plath Happy New Year! It’s the time of year when many people are making New Year’s resolutions about what they want to add or remove from their lives. As a business owner, I’m more focused on what goals I want Fortune Title Agency to achieve over the next year. What’s setting our direction for 2016? TRID The CFPB’s “Know Before You Owe” rules may have begun in 2015, but the industry as a whole hasn’t quite mastered implementing them. We did our best this year company-wide to educate current and prospective clients about the new forms and process changes. In 2016 we will continue to streamline our operating procedures, while perfecting our methods of collaboration with our clients. We’re fortunate enough to already have in place title software that allows live updating of the Closing Disclosure Form, providing convenience to our agency and lender partners who don’t have an established collaboration portal. It’s Fortune Title Agency’s aim to refine our internal processes and procedures to the end of improving the entire closing experience for our realtors, lenders, attorneys, and the consumer. This year we’re seizing the opportunity to use the new regulations as a guide to better every aspect of our business and solidify our relationships with everyone involved in the closing process. Fortune Cares – The Huntington’s Disease Society of America & Jersey Cares’ Animal Shelter Helpers

Fortune Cares is proud to support two causes this month that are extremely dear to the hearts of our staff – The Huntington’s Disease Society of America and Jersey Cares’ Animal Shelter Helpers program. It means so much for us to lend our company’s support, especially to those causes to which our staff members volunteer their time and talent.  From finding a cure for the devastatingly fatal Huntington’s Disease to aiding the homeless animals and shelters which care for them, Fortune Cares strives to support the non-profit organizations that work diligently to raise awareness and provide direct assistance, including 100% of fundraising dollars, to their causes and those who benefit from them. We were delighted to be an advertising sponsor for Jason’s Jazz Night, an evening of live jazz to raise awareness and funds to support a cure for Huntington’s Disease (HD).  For those of you unfamiliar with this disease, it is a fatal genetic disorder that causes the progressive breakdown of nerve cells in the brain.  It deteriorates a person’s physical and mental abilities during their prime working years and has no cure. There are 30,000 symptomatic Americans and more than 200,000 at-risk of inheriting the disease.  Many describe the symptoms of HD as having ALS, Parkinson’s and Alzheimer’s – all in one. Ask Nick – Intestate Succession in NJ

Question: Our Mortgagor is deceased and died without a will. She was in title with her daughter and another person. The Obituary states she is survived by her parents, brothers and a daughter. Who needs to be joined in the foreclosure action? Answer: When someone dies intestate (without a Will) in New Jersey, real property passes according the Descent Act. As of February 27, 2005, title would generally pass as follows: to the spouse; to the children; to the parents; to brothers and sisters; to the grandparents; to collateral heirs; to step-children; if none of the above, then to the State of New Jersey. Therefore, in your scenario the mortgagor’s share of the property would pass to her daughter. She should be served individually (for her existing share of the property) and as the heir of the deceased mortgagor. The other person in title should also be served. As for the rest of the family of the deceased, they would not have any interest in the property, so they do not need to be joined in the foreclosure action. Please note that succession of Heirs should be determined on a case by case basis as there are additional stipulations that may come into play upon full examination.
